The undersigned Participants voluntarily choose to participate in Activities conducted by Woody’s Airboat Tours LLC (“Woody’s”) at 2865 Big Island Road, Fremont, Nebraska. This Waiver is a legally binding agreement between Woody’s and all Participants listed on this Waiver. By signing below, each adult Participant agrees to these terms on their own behalf. The parent or legal guardian signing for any listed minor Participant certifies that they have authority to execute this Waiver on the minor’s behalf and agrees to these terms for that minor.

1. DEFINITIONS. "Woody's" means Woody's Airboat Tours LLC, its equipment, owners, operators, employees, contractors, agents, officers, and insurers. "Participant" means each adult and minor listed on this Waiver, including their heirs and legal representatives. "Activities" means all activities conducted, organized, or made available by Woody's, whether on land or water, including but not limited to airboat rides and tours, boarding and exiting boats, activities in or near the river, use of Woody's riverfront property and amenities, yard games and recreational activities, bonfires, meals, gatherings, parties, and other group activities or events.

2. RISK ACKNOWLEDGMENT. Each Participant acknowledges that Activities on land and water involve inherent risks and hazards, including but not limited to wildlife, insects, inclement weather, loud noise, equipment failure, navigational error, changing river conditions, collisions, capsizing, boarding and exiting the airboat, entering and exiting the water, activities on land, use of the riverfront property and amenities, recreational activities, and the actions of other participants, guests, or vessels. Each Participant understands that these risks may result in property damage, serious injury, illness, paralysis, drowning, or death.

3. RISK ASSUMPTION. Each Participant voluntarily assumes all known and unknown risks associated with participation in Activities, whether identified above or not, agrees to follow all instructions provided by Woody's, and accepts responsibility for any resulting medical expenses or other financial obligations. Each Participant understands that Woody's expressly disclaims liability for the inherent risks of Activities to the fullest extent permitted by law.

4. LIABILITY RELEASE. Each Participant releases, waives, discharges, and agrees not to sue Woody's for any liability, claims, demands, losses, damages, injuries, or causes of action arising out of or relating to participation in Activities, including those resulting from negligence, to the fullest extent permitted by law. This release applies to Woody's equipment, owners, operators, employees, contractors, agents, officers, insurers, and any landowner, municipal agency, or governmental agency upon whose property an Activity is conducted.

5. INDEMNIFICATION. Each Participant agrees to defend, indemnify, and hold harmless Woody's from any claims, actions, damages, liabilities, costs, expenses, or attorney's fees arising out of or related to that Participant's participation in Activities.

6. MEDIA RELEASE. Each Participant authorizes Woody's to use photographs, videos, audio recordings, interviews, reviews, and other media depicting each Participant and/or listed minor Participant in connection with Activities for promotional or other lawful purposes without compensation.

7. GOVERNING LAW. This Waiver and any action related to it shall be governed by the laws of the State of Nebraska without regard to its conflict of law principles. Each Participant consents to the exclusive jurisdiction and venue of the state and federal courts located in Dodge County, Nebraska.

8. SEVERABILITY. If any provision of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. ENTIRE AGREEMENT. This Waiver constitutes the entire agreement between Woody's and each Participant and supersedes all prior oral or written agreements relating to the subject matter of this Waiver.

10. CERTIFICATION. Each adult Participant certifies that they have carefully read, understand, and voluntarily agree to the terms of this Waiver. The parent or legal guardian signing on behalf of any listed minor Participant certifies that they have the legal authority to execute this Waiver on the minor's behalf and voluntarily agrees to these terms for that minor.
