The undersigned Passengers voluntarily choose to participate in Activities conducted by Woody’s Airboat Tours LLC (“Woody’s”) at 2865 Big Island Road, Fremont, Nebraska. This Waiver is a legally binding agreement between Woody’s and all Passengers listed on this Waiver. By signing below, each adult Passenger agrees to these terms on their own behalf. The parent or legal guardian signing for any listed minor Passenger certifies that they have authority to execute this Waiver on the minor’s behalf and agrees to these terms for that minor.

1. DEFINITIONS. "Woody's" means Woody's Airboat Tours LLC, its equipment, owners, operators, employees, contractors, agents, officers, and insurers. "Passenger" means each adult and minor listed on this Waiver, including their heirs and legal representatives. "Activities" means all activities conducted by Woody's, including but not limited to tours, bonfires, meals, and parties.

2. RISK ACKNOWLEDGMENT. Each Passenger acknowledges that Activities involve inherent risks and hazards, including but not limited to wildlife, insects, inclement weather, loud noise, equipment failure, navigational error, changing river conditions, collisions, capsizing, boarding and exiting the airboat, entering and exiting the water, activities on land, and the actions of other passengers or vessels. Each Passenger understands that these risks may result in property damage, serious injury, illness, paralysis, drowning, or death.

3. RISK ASSUMPTION. Each Passenger voluntarily assumes all known and unknown risks associated with participation in Activities, whether identified above or not, agrees to follow all instructions provided by Woody's, and accepts responsibility for any resulting medical expenses or other financial obligations. Each Passenger understands that Woody's expressly disclaims liability for the inherent risks of Activities to the fullest extent permitted by law.

4. LIABILITY RELEASE. Each Passenger releases, waives, discharges, and agrees not to sue Woody's for any liability, claims, demands, losses, damages, injuries, or causes of action arising out of or relating to participation in Activities, including those resulting from negligence, to the fullest extent permitted by law. This release applies to Woody's equipment, owners, operators, employees, contractors, agents, officers, insurers, and any landowner, municipal agency, or governmental agency upon whose property an Activity is conducted.

5. INDEMNIFICATION. Each Passenger agrees to defend, indemnify, and hold harmless Woody's from any claims, actions, damages, liabilities, costs, expenses, or attorney's fees arising out of or related to that Passenger's participation in Activities.

6. MEDIA RELEASE. Each Passenger authorizes Woody's to use photographs, videos, audio recordings, interviews, reviews, and other media depicting each Passenger and/or listed minor Passenger in connection with Activities for promotional or other lawful purposes without compensation.

7. GOVERNING LAW. This Waiver and any action related to it shall be governed by the laws of the State of Nebraska without regard to its conflict of law principles. Each Passenger consents to the exclusive jurisdiction and venue of the state and federal courts located in Dodge County, Nebraska.

8. SEVERABILITY. If any provision of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. ENTIRE AGREEMENT. This Waiver constitutes the entire agreement between Woody's and each Passenger and supersedes all prior oral or written agreements relating to the subject matter of this Waiver.

10. CERTIFICATION. Each adult Passenger certifies that they have carefully read, understand, and voluntarily agree to the terms of this Waiver. The parent or legal guardian signing on behalf of any listed minor Passenger certifies that they have the legal authority to execute this Waiver on the minor's behalf and voluntarily agrees to these terms for that minor.
